What is licensing?

Licensing is the process of granting permissions (licenses) for the performance of certain activities or the use of intellectual property objects. The list of licensed areas of activity is determined by the legislation of a specific country or international norms. For example, areas such as the production and sale of pharmaceuticals, weapons, passenger transportation, as well as educational and medical activities are subject to licensing.

In Russia, over 50 types of activities require licenses, as detailed in Article 12 of Federal Law No. 99 "On Licensing Certain Types of Activities." Licensing in these areas is mandatory, and the relevant permits are issued by authorized bodies, which record them in a registry. This simplifies the verification of license authenticity.

Why is licensing necessary from a legal perspective?

States implement licensing to protect the rights and interests of citizens and to ensure safety. Activities related to risks to health, life, legal interests of citizens, national security, and the environment are subject to licensing. For each type of activity, there are licensing provisions that specify conditions and requirements, as well as the authority authorized to issue licenses.

In the field of educational activities, the direction, form, and specifics of education are taken into account. Licensing allows the government to monitor the activities of entrepreneurs and organizations, establishing requirements that businesses must comply with. This may include the availability of necessary facilities, material and technical base, as well as employment contracts with qualified specialists.

Authorized bodies regularly check compliance with legislation by license holders. In the event of violations, they can revoke the license. Engaging in licensed activities without permission is subject to various types of liability, including fines and even criminal liability.

What is the purpose of licensing for businesses?

Having a license indicates that a company meets established requirements and standards, thereby ensuring the safety of products and services for clients. Licensing provides the following advantages for businesses:

  • Safety: Entrepreneurs operate within the law, helping to avoid risks to their business, property, and reputation.
  • Competitive advantage: Licensing allows companies to emphasize safety and compliance with regulations when promoting products and services.

For patients of medical institutions, it is important to pay attention to the licensing of private clinics. Information about the presence of permits for medical activities should be accessible. The absence of such information can be grounds for a prosecutor's investigation and the closure of illegal clinics.

How to obtain a license?

The process of obtaining a license varies depending on the type of activity and regulatory document. For example, there are specific requirements for credit organizations and the production of alcoholic beverages. To obtain a license, an entrepreneur must submit a package of documents to the authorized body, which checks compliance with all requirements and, if necessary, conducts an on-site inspection.

An application for a license can be submitted through State Services, but only with a verified account. Licenses have a specific validity period, after which they need to be reissued. In some cases, licenses are indefinite but may require reissuance in case of address changes or company reorganization.

Licensing of intellectual property

The licensing law covers the results of intellectual activity, such as scientific discoveries, books, musical works, and other objects. The licensing process involves the transfer of rights from the right holder (licensor) to another person (licensee) through a licensing agreement. A license is a written permission to use an object granted by the owner of the exclusive right.

The licensing agreement is made on a reimbursable basis, where the licensee receives temporary rights to the object in exchange for royalties or fees. In Russia, the list of protected intellectual property objects is established in Article 1225 of the Civil Code. Depending on the rights granted, simple (non-exclusive) and exclusive licenses are distinguished.

Licensing on the internet

On the internet, most content is protected by copyright. Entering into a licensing agreement or acquiring a license is necessary for the legal use of someone else's content, including texts, music, and images. There are different types of licenses for protecting content on the internet:

  • Free licenses (Creative Commons): allow the use of content for non-commercial purposes with attribution.
  • Paid licenses (Royalty-Free, Extended Royalty-Free): establish the terms of use of the content and the payment amount.
  • Proprietary licenses of resources: platforms develop unique licensing documents with usage conditions.

It is important to strictly follow the terms of the licensing agreement when using someone else's content to avoid copyright violations, which can lead to fines and criminal liability.
